Together, ovarian, breast and colon cancers claim the lives of more than 100,000 Americans each year. Yet, according to the American Cancer Society's 2008 edition of "Cancer Facts & Figures," cancer deaths have declined dramatically since the early 1990s - thanks in part to advances in the way doctors can monitor their patients' progress during and after cancer therapy.

"When dealing with such prevalent and challenging cancers as ovarian, breast and colorectal, accurate and detailed information can make a drastic difference in the progress and ultimate prognosis for the patient," explains Zsuzsanna Vegh-Goyarts, PhD, Assistant Director of Flow Cytometry and Tumor Markers at Acupath Laboratories. "Today, physicians can order simple blood tests that will tell them how their patients are responding to a particular drug regimen or radiation treatments, or indicate whether or not a patient is in remission." she adds.

The Triple Threat Against Cancer: CA-125, CA 15-3 and CEA
Many of the advances made in testing for cancer in serum, or blood revolve around the identification of certain proteins that are either made by the tumor itself or created by the body in response to the cancer. Dr. Vegh-Goyarts notes, "Three examples of such substances that are most often tested are CA-125 for ovarian cancer, CA 15-3 for advanced breast cancer and CEA for colorectal cancer." Yet, she notes that levels of these proteins are not always elevated in cancer, so these tests cannot be used as a diagnostic tool. "These substances can also be elevated in a variety of benign conditions, such as pregnancy, benign cysts, hepatitis and cirrhosis." Dr. Vegh-Goyarts adds.

Once a cancer diagnosis is confirmed with various other tests and procedures, however, these tests are often performed to provide a baseline level before treatment starts that doctors can use them to gauge the success of treatments. "For instance, if CEA levels remain high in a colorectal cancer patient after surgery, this may indicate that the procedure did not effectively remove all the cancerous tissue, and surgeons may decide to operate again," Dr. Vegh-Goyarts explains. "Or, persistant elevated CA 15-3 levels after a complete course of chemotherapy may suggest that the patient would be more responsive to a different approach," she adds. Similarly, falling levels - and levels that reach and stay within normal limits - can indicate that a patient is entering remission. Increase from normal to abnormal levels may indicate recurring disease. Follow up a patient's condition is possible for years using these assays.

"One of the most beneficial aspects of these tests is that they are very easy for patients to tolerate and comply with," Dr. Vegh-Goyarts notes. "We are able to receive a great deal of valuable information with very little discomfort to the patient, and often avoid more invasive procedures as well," she adds.

New, More Comprehensive Diagnostic Tests on the Horizon
Research for noninvasive tests for cancer screening from blood, urine or stool has made significant progress in the past few years. The substances scientists test for are either made by the cancer cells themselves or produced during the immune response against the cancer. Many researchers are currently in the process of developing and trialing tests that can help diagnose cancer early - especially cancers like ovarian and colorectal that are often identified. For instance, the American Cancer Society and several other groups recently released new guidelines for colorectal cancer screening that included the "sDNA" test, a screening that can identify DNA derived from cancer cells in stool samples. In addition, a blood test that has been shown to diagnose ovarian cancer in its earliest, most curable stages with nearly 99% accuracy - by detecting the presence of a number of proteins linked to the cancer itself - is currently in Phase III clinical trials with the FDA.

Who: Guy Fernandez was a Baltimore resident, loving husband, father, son-in-law and friend. He was 49 years old, a non-smoker with a 34" waist. He had no prior symptoms of heart disease - no chest pain or shortness of breath - and three severely blocked arteries. He died instantly of a massive heart attack ten (10) days after receiving a clean bill of health from his primary care physician.

Why: Guy Fernandez's story is reflective of an unrecognized fact: every day over 1900 previously healthy individuals arrive at emergency rooms with a 1st-time heart attack. "Using traditional risk assessment guidelines, about 80% of them would have been considered to be at low to intermediate risk prior to their heart attack," said Dr. Morteza Naghavi, Chairman of the Board of SHAPE.

"It has been obvious for some time that new strategies are needed to fight the growing epidemic of atherosclerotic cardiovascular disease. The following are salient points from the article:

Many people hold the unfortunate belief that when they become involved in a lawsuit – including divorce - they need to find a lawyer who is a "fighter," or "pit bull" (i. e., like the dog bred specifically to fight other dogs). Since legal disputes are adversarial by nature, the logic seems to be that an aggressive attorney will more successfully advance one's interests in court. By logical extension, a lawyer who is not ruthlessly aggressive would be a suboptimal choice.

However, strong, proactive, and even aggressive representation does not necessarily equate with the "pit bull model." Attorneys classified as pit bulls often tend to be belligerent, argumentative, and eager to fight. What the public does not realize is that highly contentious individuals (attorneys included) usually place self-interest above all else. It should be obvious that always looking for more points to fight over, and even taking unreasonable positions on behalf of their clients, generates significantly more money in fees for the lawyer who charges on an hourly basis. Moreover, such attorneys tend to derive a great deal of pleasure from the fight in and of itself. In fact, many attorneys enter the field precisely because they enjoy argumentative confrontation, and tend to be disagreeable and difficult people in general.

These attorneys thus tend to delay the resolution of a case, file motions that make no sense from a cost/benefit analysis, and often cause the other side to need to file motions, or incur significant legal fees and costs because their client is refusing to disclose required information and/or is hiding marital assets. (Difficult and combative clients tend to retain difficult, combative counsel, while reasonable and cooperative clients usually retain more reasonable representation.)

"Pit bull attorneys” are not concerned with resolving a case in a fair and equitable manner, despite the fact that the family law court is considered a court of equity, or fairness. Instead, these attorneys take advantage of the flaws and imperfections in the legal system to make the case for the other side so costly that they either cannot or will not continue to fight for that to which they are otherwise legally entitled. Such attorneys are focused on "winning," no matter what the cost, irrespective of right and wrong, and in total disregard of equity.

In truth, the very concept of "winning" in court is somewhat subject to interpretation. For example, if a particular attorney "wins" a client $30,000 in a case that more qualified attorneys would have potentially "won" $300,000, is that considered a "win?" The attorney did "win"- insofar as the opposing side ultimately lost the case. However, wasn't a more appropriate resolution lost? Then again, what if an aggressive attorney causes both sides to incur legal fees in the sum of $30,000, and yet ultimately "wins" only $5,000 for his/her client. Should that be considered a "win?" And, if so, for whom?

At Mark B. Baer, Inc., a Professional Law Corporation, we recognize that neither of these situations can be considered to be a true victory for the client. While ruthless and combative attorneys, and other such people, would argue that a "win" is a "win," this point of view assumes that the only thing that really matters is that the other side is defeated. The true "winner" in such situations is the attorney. While some may argue that the client "won" his or her debate as a matter of principle, and that the toll it may take on both sides is irrelevant, the cost (both financial and emotional) of fighting with this notion as a guiding force is often just not worth it. If clients realized the extreme emotional and financial toll in advance of pursuing such principles, many would not do so. This is especially true if the vindictive emotions that fuel such legal wrangling could otherwise be diffused through the use of psychologists and other such mental health care professionals.

Disagreeable, contentious clients tend to seek out similarly oriented attorneys. Interestingly enough, such individuals tend to relate well with each other-at least at first. Meanwhile, a client who tends to be more cooperative might retain an attorney who is more antagonistic toward others and vice versa, but such relationships do not tend to last. Ultimately, the difficult client and difficult attorney will not be able to treat each other any differently than they treat anyone else. Furthermore, the more reasonable client very often parts way with his or her overly aggressive attorney before long. These sorts of mismatching are why clients might go through several different attorneys in course of a single particular legal proceeding.

"Pit bull attorneys" and their clients can rarely, if ever, have a successful working relationship and a positive outcome in the legal proceeds because they are unable to maintain trust, mutual respect and good communication, which are crucial aspects of the relationship.

At its regularly scheduled meeting on Tuesday, September 14, the board of the Hospitals and Higher Education Facilities Authority accepted the resignation of its president and CEO, Wayne A. Mugrauer and voted to name James B. Baker, Jr., a member of the board, to serve as interim CEO, as it launches a national search for Mugrauer’s successor.

Mugrauer, who assumed his position at the Authority in July 2007, will join the Sellersville, Pa-based Penn Foundation, as its new chief executive. The Penn Foundation provides mental health, mental retardation, and substance abuse services for children, adults and institutions located primarily in Bucks and Montgomery Counties, in Pennsylvania.

According to Robert W. Bogle, chair of the Hospitals and Higher Education Facilities Authority’s board, Mugrauer has served the Authority and its clients exceptionally well during his three-year tenure. “Over his tenure, we developed a great sense of confidence in the way in which Wayne Mugrauer managed our operations. We expect that he will make an equally creditable contribution at the Penn Foundation. In the meantime, we do not expect that there will be any lack of continuity in the quality of our services under Jim Baker, as we complete our national search.”

Established in 1974, The Hospitals and Higher Education Facilities Authority offers low-interest, long-term, tax-exempt financing to non-profit hospitals and to secondary higher education facilities. Over the past 10 years, the Authority has facilitated 27 such financings, averaging more than $60 million, each.
