"Once solely a 'New Age' preoccupation, feng shui has lured such soulful '90s converts as Donald Trump and Oprah Winfrey," Holderread said. "'The Donald' consulted a feng shui specialist before building his hulking Trump International Hotel in New York -- hence the blinding silver globe out front at Columbus Circle. And Oprah is purported to have worked out her chi issues with a consultant. Even Wall Street has taken stock of its chi flow."

Federal Circuit decision entered, affirming decision from Eastern District of Texas that turned on patent attorney "Hal" Hallihan's patent invalidity arguments

The U. S. Court of Appeals officially entered a judgment into the record affirming a summary judgment ruling from the Eastern District of Texas.

In Iovate Health Sciences Inc. et al v. Bio-Engineered Supplements & Nutrition Inc. (Case Number 9:07-cv-0046-RC), Iovate, the University of Florida Research Foundation, Inc. (UF), and Flamma SpA filed a complaint against Bio-Engineered Supplements & Nutrition (BSN) and Medical Research Institute (MRI) in Texas for patent infringement (http://www. hallihan. com/Chicago_Patent_Attorneys. html) in 2007.

Iovate is the exclusive licensee of UF's patented method for "enhancing muscle performance or recovery from fatigue" (Pat. No. 6,100,287). The method includes the single step of administering a composition that contains a ketoacid and either a cationic or dibasic amino acid.

BSN was defended by a Chicago-based law firm whose team was led by experienced patent attorney William J. "Hal" Hallihan (http://www. hallihan. com/Our_IP_Team. html). Hallihan sought to invalidate Iovate's patent claims with an innovative argument for summary judgment and was ultimately successful when Judge Ron Clark ruled, prior to trial, that numerous patent claims were anticipated under 35 USC 102(b).

"The most relevant prior art were advertisements found in bodybuilding magazines," explained Hallihan. "Each ad mentioned specific ingredients, administering the supplement, and marketing claims and testimonials from bodybuilders extolling the virtues of the product. We successfully argued that the advertising disclosed all limitations of the invalidated claims, including the chemical components, as well as the function of administration to enhance muscle performance."

On appeal, the Federal Circuit affirmed the summary judgment ruling in a November decision. That decision was entered into the record in January 2010.

The case comes on the heels of a similar dispute having similar results. In Medical Research Institute (MRI) v. Bio-Engineered Supplements and Nutrition Inc (BSN) et al (Case Number: 6:05-cv-00417-LED), MRI sued BSN in 2005 for patent infringement in the Eastern District of Texas. In this case, Hallihan successfully argued that MRI's use of the term "comprising" in its claims fell within an exception to the general rule that such term means the claim is open-ended. In 2007, Judge Leonard Davis ruled in favor of BSN and taxed BSN's costs against MRI.

Department of Interior Secretary Ken Salazar to fire a senior Interior official named Craig Littlejohn, who referred to African-American subordinates as “monkeys.”

In a letter to the Interior Secretary Ken Salazar, Mr. Philip Taylor, C4C, Inc.'s Acting President wrote, “ . . . the recent Equal Employment Opportunity Commission’s decision detailing Mr. Craig Littlejohn’s racist name-calling and his discriminatory interference with the selection process makes him unfit to serve in a position of public trust in the Federal government.” In his letter, Taylor added that C4C members were deeply troubled that department officials have failed to administer prompt or appropriate disciplinary action against Littlejohn in light of the EEOC’s decision and an article in The Washington Post.

The EEOC Decision [EEOC No. 570-2008-00625X, July 2, 2010] details how Littlejohn, who after becoming Chief Information Officer in the Office of Solicitor moved the African-American employees under his supervision out of the headquarters office and replaced them with non-African American contractors.

Mr. Philip Taylor, C4C, Inc.’s Acting President states “Department of Interior officials’ failure to address Mr. Littlejohn’s blatant transgressions serves to condone the hostile and intolerable work environment that he has created for minority employees under his supervision.”

“It would appear from reading the judge’s ruling that Mr. Littlejohn does not represent the type of individual an organization would desire to lead a diverse workforce in the 21st Century," stated Taylor. A Natural Treatment for Heart Disease – Cell Therapy

The body has natural ways of healing itself and the cardiovascular system is no exception. Endothelial progenitor cells (EPCs) originate in bone marrow and then circulate in the blood vessels.

To manufacture VesCell (TM), TheraVitae expands a small number of EPCs harvested from about 250cc of blood into a therapeutic quantity. The EPCs are injected either through a coronary artery via catheter from the legÂ’s femoral artery or during surgery, directly into the heart muscle.

Millions of people die each year from coronary artery disease. The cause of coronary artery disease is atherosclerosis — the gradual buildup of plaque and narrowing of the blood vessels that supply the heart muscle. Eventually, cardiologists and surgeons must widen the occluded artery by inflating balloon in it or must bypass the occluded section by surgically attaching a blood vessel to circumvent the blockage. Of the 1,340 participants in the poll, 40% would like to see a special section in the back of journals, magazines and newspapers that contains advertisements. In contrast, only 24% of those surveyed would like the status quo to remain and believe that advertisements should be distributed throughout the publication. The remainder, 10%, would like advertisements to be located in the front of publications.

According to the Southern Poverty Law Center, a civil rights organization in Montgomery, Ala., the number of hate groups (http://www. splcenter. org/intel/map/hate. jsp) operating in the U. S. has grown 54 percent in the last eight years. Today, nearly 1,000 hate groups operate in the U. S., with 30 in North Carolina. The Southern Poverty Law Center’s Intelligence Report sites “immigration fears, a failing economy, and the successful campaign of President Obama” as factors that have fueled the increase. Hate groups have beliefs or practices that attack or malign entire classes of people. They promote hate, hostility, and sometimes violence.

In response, the YWCA created the Stand Against Racism to combat the spread of hate and intolerance, and to celebrate the richness of diversity. In 2009, the movement attracted more than 300 partner organizations that became participating sites by hosting local “Stands.” More than 30,000 individuals took a stand against racism. They sent a strong message by committing themselves to a lifetime of promoting peace, justice, freedom, and dignity for all people in their community and in the world. This powerful, unified effort helped raised awareness that racism hurts everyone. Participants ranged from school-age children to elected officials, executives of large corporations, church leaders, and others.

“The YWCA Greater Triangle is calling on all local organizations, corporations, places of worship, government agencies, and individuals across the region and state to join with us by becoming a participating site for the 2010 Stand Against Racism,” said Folami Bandele, executive director, YWCA Greater Triangle. “Any group of any size that believes in a society free of racism is invited to join us.”

Organizations and groups can become participating sites by signing up through the Stand Against Racism Web site (http://www. StandAgainstRacism. org). Each site will host a Stand Against Racism event at their own location, which can be private or open to the public. Participation in the 2010 Stand Against Racism is free and signup is simple. The Racial Justice program of the YWCA Greater Triangle serves as a resource in the community for increasing awareness and opening dialog about race and ethnicity that goes beyond the terror of hate groups. Scientists from the World Health Organization are again sounding the alarm on the influenza A (H5N1) virus, Z strain, commonly known as "Bird Flu".
