ARLINGTON, VA – November 8, 2002 – Academic medical centers provide exceptional acute care, train tomorrow's physicians, and conduct cutting edge research. Given the financial pressures most centers are currently facing, the future viability of this tripartite mission is in jeopardy. In order to help determine where to cut expenses, members of The Science Advisory Board were asked which of these three activities is the least critical. Almost half of the 561 respondents stated that the provision of health services is the most dispensable, followed by 34% who thought research and 17% who believed teaching could be eliminated.

As health care becomes more price competitive, all payers—including private payers, Medicare and Medicaid—are decreasing their payments to academic medical centers. Concurrently, academic medical centers are charged increasingly higher rates for labor, drugs, medical devices, new technologies and information system upgrades. These reduced payments and increased expenses mean that many academic medical centers can no longer adequately support the costs of patient care, teaching and research.

“Despite struggling to reduce costs by improving efficiency and cutting back on some programs, academic medical centers may still be faced with an almost impossible choice,” predicts Dr. Tamara Zemlo, Director of The Science Advisory Board, “which one of our three missions should we eliminate?” Since they are so interdependent, many in the health care community believe that one cannot be eliminated without severely impacting a center’s ability to fulfill its other two missions.

However members of The Science Advisory Board believe that when faced with such a tough decision, teaching and research should prevail. The debate then becomes who will provide complex tertiary care to the public and ensure the transition of new services and technologies into the mainstream health care delivery system?

People have recently become more preoccupied with nutrition issues than ever before, so you would think that we should naturally have equal concern for our dogs and cats... especially since we generally consider them to be a part of the family. We should want the ingredients in our pet food to be human grade or at least nearly so.

If byproducts are shunned in our own food, why are they be allowed in our animals' food? Do we want them to live to their maximum lifespan? Of course we do. Nobody enjoys seeing their beloved pet, whom they have truly formed a bond with, get sick and slowly die. We are now seeing that our dogs and cats in fact need daily supplements the same way that people do, in order to take care of their bodies for the inevitable stresses of the aging process. In the span of an animal's life, an early start at good health ensures less vulnerability to certain degenerative diseases, joints that are less likely to creak with pain and a healthier heart.

Holistic veternarian Dr. Jane Bicks claims that when studying dog food, one should be be on the lookout for dyes, and other chemicals as much as possible. For example, BHA, which is one of the primary synthetic antioxidant preservatives used to prevent food discoloration, has been shown to cause cancer in laboratory rats at some doses. In lesser doses, the preservative does not show a cancerous effect but who knows what BHA can do to their bodies in small doses over a long time span.

Dr. Jane states that the maximum life span of dogs is estimated to be between 25 to 30 years, but the average dog often lives no longer than 13 to 14 years. And she says that this difference is caused mostly by inadequate nourishment.

She also states that protein is an overlooked but vitally importartant part of a dog or cat's natural development.

Harder working or more energetic dogs and cats need more protein as well as fat in their diets to support their stamina. A dog food that is complete and balanced and includes at least 26 percent protein and 1650 kilocalories of metabolizable energy per pound. During the seasons when dogs are not working, feed them less of the caloric-dense dog food.

The first study of its kind, published in the May issue of the Journal of Asthma, found that participants significantly improved their breathing capacity, reduced medication use two-fold, increased the number of days without symptoms four-fold, and experienced reduced symptom severity when an asthma attack did occur.

Ten million people in the U. S. suffer from allergic asthma, and poor indoor air quality contributes to the problem. The study, funded by an NIH Small Business Innovative Research grant, offers hope for an inexpensive and safe way to control allergic asthma. This grant allowed for a small-scale trial to see if a larger study was warranted.

Nineteen mold-sensitive asthmatic children, 5 to 17 years of age and living in homes with central ventilation systems, were enrolled in the 28-week trial. The conclusion found that central UV irradiation is highly effective and recommended a larger controlled longitudinal study to validate the health effects.

Dr. Jonathan Bernstein, a nationally recognized specialist in environmental asthma at the University of Cincinnati, conducted the study. The technology tested in the study, the CREON2000 Photonic system, has several patented innovations and was invented by Dr. Mark Glazman to help alleviate his wife’s allergies and asthma. With this information, the University of Pennsylvania study appears to simply become an advertisement for Weight Watchers, potentially to the benefit of the University of Pennsylvania and the American Dietetic Association.

At the very least, ISAA believes that this indicates a lack of objectivity and conflict of interest. ISAA feels the public has a right to know these facts in determining whether the study poses relevant information or is in fact propoganda.

ISAA does not endorse weight loss dieting, instead recommending fitness and healthy food choices in combination with improving self-esteem.

Lawsuit Challenges NY Bottle Bill’s Labeling and Special Exemptions

The International Bottled Water Association (IBWA) today announced that it has filed a lawsuit challenging the constitutionality of newly-added provisions of New York’s Returnable Container Act (RCA) – also known as the “Bottle Bill”.

The International Bottled Water Association (IBWA) today announced that it has filed a lawsuit challenging the constitutionality of newly-added provisions of New York’s Returnable Container Act (RCA) – also known as the “Bottle Bill” (Manhattan District County 09CiV4672). The suit alleges that certain Bottle Bill provisions added as part of New York’s 2009-2010 budget law improperly impedes interstate commerce while violating IBWA members’ equal protection and due process rights.

Joining IBWA as plaintiffs in this lawsuit are Nestle Waters North America, Inc. and The Polar Corporation d/b/a Polar Beverages.

The Bottle Bill, originally passed in 1982, is intended to encourage recycling and to reduce litter and waste. It requires consumers to pay a five cent deposit when purchasing certain bottled beverages and permits consumers to obtain a refund of that deposit by returning the empty bottle to the retailer.

The Association strongly supports the Bottle Bill’s goal of encouraging recycling and environmental conservation and is not challenging the deposit requirement or the recycling portions of the Bottle Bill. Rather, the IBWA lawsuit concerns the new labeling requirements, unrealistic effective date and special exemptions granted to certain IBWA members’ competitors in the recent Bottle Bill amendments. 

Under the new Bottle Bill, all bottles covered by the law must contain a special New York specific bar code. The law prohibits bottles with that New York bar code from being sold in other states, even if those states’ laws would permit the sale. IBWA believes that the New York bar code requirement is unconstitutional because it controls commerce occurring in other states.

While the new Bottle Bill applies to nearly all forms of bottled water, including flavored water, vitamin water, and water containing artificial sweeteners, it creates an exception for bottled water products that have sugar added. The new Bottle Bill gives no reason why water with sugar should not be covered by the law when all other forms of water are covered. Indeed, the sugar water exception runs counter to the important environmental goals of the Bottle Bill. IBWA believes this arbitrary exception, which gives special preference to companies that sell sugar water products, violates the U. S. Constitution’s Equal Protection Clause.

IBWA also seeks a reasonable amount of time for its members to comply with the new Bottle Bill, which is set to take effect in just a few weeks, on June 1, 2009. The new Bottle Bill imposes a number of different requirements on IBWA members, including the need to design new product labels, register those labels with the State, implement a distribution system that ensures New York-labeled bottles are offered for sale only in New York, and create a process to handle redemption of empty bottles by consumers.

IBWA members are unable to prepare for all these complex requirements in such a short time (less than 60 days after the law was passed). The original law provided the soft drinks and beer industries 15 months to comply with a far simpler system than the recently enacted changes. IBWA has asked the court to prevent the new Bottle Bill from taking effect for a reasonable period of time sufficient for its members to prepare for the law’s new requirements.

Bottled water is a safe, healthy, convenient food product and consumers appreciate its refreshing taste and use it to stay hydrated. The new bottled deposit law is not in the public interest because it will discourage and possibly prevent consumers from making a healthy beverage choice. By including an arbitrary exception for water products that have sugar added, the new law provides financial disincentives for consumers to drink bottled water. We should be creating incentives for consumers to drink healthy beverages, such as bottled water, instead of making them more expensive. Moreover, because it will be impossible for companies to meet the law’s June 1 effective date, it is likely that New York consumers may soon not even be able to find bottled water on their store shelves.
