Reverend Tom Kelly is the President of Soul of Yoga, a non-denominational Yoga school that supports a spiritual perspective on every day living. This course addresses the application of legal and ethical mandates expected of reasonable and prudent mental health clinicians when facing unpredictable and potentially damaging crisis issues, such as the threat of suicide, child abuse accusations, elder abuse issues, anorexia/bulimia, and many others.

Dr. Grosso bases this presentation on a variety of mental health legal cases in which he served as a successful expert witness. He points out that these legal cases reinforce the premise that crisis issues are unpredictable in nature; require an appropriate structure to manage them when they occur; the mental health clinician must have the appropriate training, knowledge, and education to manage these issues; be able to recognize presenting clinical risk factors, apply the appropriate legal and ethical standards, take reasonable steps to protect the life of the client, assess, diagnose, and treat throughout the duration of therapy according to the Standard of Care; and document his or her assessments, diagnoses, and treatment appropriately in the mental health records.

Crisis issues tend to develop unstoppable momentum once they begin and by then, itÂ’s too late to try to go back and change clinical errors or omission and commission. These errors range from not knowing how to assess for risk factors to breaching confidentiality without having an understanding of the legal therapeutic duty regarding mandated or permitted reporting to protect a client from harming him/herself or others. This course presents a detailed structure that would support a reasonable and prudent clinicianÂ’s legal and ethical therapeutic duty to assess, diagnose, and treat according to the standard of care throughout the duration of treatment.

The structure proposed in this course introduces the clinical dangers faced by mental health clinicians when they face crisis issues including, child abuse, elder/dependent abuse, Tarasoff situations, anorexia, bulimia, suicide, spousal abuse, etc. Any of these situations can cause severe physical or emotional harm to the client, his or her family, others outside of the treatment unit, and even the clinician and those associated with him or her. The structure next addresses the necessary and appropriate assessment protocols that would support a clinician’s legal duty to assess appropriately. In conjunction, these serve to provide the clinician to obtain an appropriate 5-Axis diagnosis, which is the standard of care of the profession and supported by many prominent expert witnesses in this arena. The appropriate use of treatment plans, used as a treatment and assessment tool, and other documentation protocols are used extensively throughout the course to support the clinician’s decisions. The course also relies on a variety of clinical vignettes exemplifying the standard of care, errors of omission and commission, and these help clinicians navigate the vagaries of crisis issues. Dr. Grosso’s forensic and clinical experience makes this an extremely useful and valuable course for new and seasoned clinicians. As he frequently reminds clinicians: “Once the crisis has taken place, it’s too late to change clinical decisions.” He also warns clinicians about altering written records: “The technology is such that alterations are easily discernable by forensic experts. Should the clinician be found to have altered a mental health record, he or she can be found guilty of unprofessional conduct and most likely will place his or her license in jeopardy.”

Health care leaders announced they are making a down payment on a bold strategy for solving Maryland's long-term nursing crisis. Donors have pledged $15.5 million over five years and 17 Maryland schools of nursing will receive grants from these funds to educate more nurses. The first round of grants will increase the number of nurses graduating by 300 students and add 20 faculty positions.

Today, health care leaders said they are making a down payment on a bold strategy for solving Maryland's long-term nursing crisis when they announced:

 Donors have pledged $15.5 million over five years; and  17 Maryland schools of nursing will receive grants from these funds to educate more nurses.

Maryland hospitals and nursing education leaders first announced the strategy to double the number of nurses educated in Maryland in November 2007. The first grants will increase the number of nurses graduating by 300 students and add 20 faculty positions.

"Less than two years ago we predicted that unless we increased the number of nurses being educated in Maryland we would be short 10,000 nurses by 2016," said Maryland Hospital Association President and CEO Carmela Coyle. "Today we are thrilled to announce real progress and are committed to maintaining the momentum we need to reach our goal of adding 1,500 students."

The announcements came today at the Maryland Hospital Association during a public celebration of the initial phase of fundraising and the awarding of grants to 17 nursing schools to enable them to expand enrollment.

"With major efforts underway to expand health care access, it is likely there will be an even greater need for nurses," said Campaign Co-Chair, and CareFirst BlueCross President and CEO Chet Burrell. "We have pledged significant support for the program, and the progress of the campaign brings us a step closer to addressing the question of who will care for the next generation of Marylanders."

The fundraising campaign, which is known as Who Will Care?, has attracted a broad-based group of concerned hospitals, insurance, business, and academic leaders; as well as nurses, long-term care providers, and concerned private citizens. In all $60 million from the public and private sector is sought to fully fund the initiative.

"In recent years Maryland nursing schools have had to turn away qualified applicants because there are simply not enough faculty available to handle additional numbers of students," said Campaign Co-Chair, and Hopkins Health System President Ronald R. Peterson. "Yet the number of nurses graduating in Maryland is not keeping pace with the nurses we will need in the next 10 years. These grants will begin to increase the number of nurses so we won't face a huge chasm when almost half of the nursing workforce retires just as the baby boomer generation's health needs reach their peak," he explained.

The leaders acknowledged that the recession makes the nursing shortage appear smaller, but warned against a false sense of security. "The recession only masks the problem," Coyle pointed out.

"When the economic downturn ends we will face an exodus of nurses who postponed retirement and expanded their hours. We cannot take our eye off of the long-term goal of meeting our future nursing demands," Peterson added.

The 17 schools that will receive these initial grants include community college nursing programs and four-year baccalaureate programs from across Maryland. The grants will be used to provide additional operating dollars to schools to add faculty, students, and clinical technology. "Today's progress benefits all Marylanders. Tony Verdone volunteers for Raleigh-based nonprofit that serves individuals in transition

Tony Verdone enjoys helping others. The Vice President of Development at MediClick supports his team as they successfully engineer Software-as-a-Service solutions for the healthcare supply chain. But during the past year, Verdone has quietly been teaching computer skills to those in need in the Raleigh community.

As part of the International Free Computer Training & Charitable Center (IFCTCC), a nonprofit that trains and educates those interested in enhancing their computer skills and job marketability, he joins other volunteer instructors who train individuals on everything from Microsoft Excel and Word to Web Design and SQL programming.

“These volunteers are great assets to our community,” says Joe Mabiala, who founded IFCTCC in September 1998 with donated equipment and volunteer instructors. “The change they have brought to the life of the communities that we serve is overwhelming.”

The program enables Verdone to give back to the community by teaching computer skills to unemployed and low-income individuals, those who cannot afford a formal education and those new to the U. S. workforce.

“Before I was in IT, I was a high school math instructor and adjunct professor,” says Verdone. “I’ve never lost my verve for the classroom. IFCTCC enables me to combine my two loves, technology and teaching.”

He’s been instructing a Microsoft Excel class during the IFCTCC fall 2010 semester. He taught the same course during the spring 2010 semester.

“Tony has been a great asset to our program,” Mabiala says. “His gentle style, patience and connection with his students proves what a great teacher he is.”

As businesses are starting to emerge out of one of the worst recessions we have seen there are many competing issues for limited resources. In a recent survey conducted by Security Directory News workplace violence was rated the top issue of concern with roughly 49% of respondents. With this level of concern by Security professionals organizations need to think long and hard about allocating resources to combat this life threatening issue that can not only cause employees to lose their lives, but severely impact the reputation and public image of their organization. Preeminent workplace violence expert, W. Barry Nixon, Executive Director, National Institute for the Prevention of Workplace Violence, Inc., has released the ‘Ten Key Lessons Learned From Incidents in the 21st Century'' with the goal to help organizations to adapt these knowledge to their workplace to improve their violence prevention efforts. The lessons give both public and private organizations key insights to interventions and tools that they can implement in their workplaces that will help to reduce the likelihood of workplace violence.

According to the Bureau of Justice Statistics, approximately 500,000 victims of violent crime in the workplace lose an estimated 1.8 million workdays each year; an astounding $55 million in lost wages for employers. The prevention of workplace violence needs to become a high priority for any business that values its employees, reputation and future sustainability.

These key lessons were gleaned from high profile workplace shootings at Virginia Tech, CNN, Binghamton American Civic Association, Fort Hood, Penske Truck Rental, Ohio State, University of Alabama, Emcore Fiber Optics, Kraft Foods to name a few as well as many lessor reported incidents.

1. Prevention Cost Are Infinitesimally Small Compared to the High Cost of an Incident
The cost of an workplace violence shooting incident can be astronomical compared to prevention and preparedness cost. Our research found that there is a 20 to 1 ratio. An example of an incident cost is Virginia Polytechnic Institute and State University which has been reported as incurring $8 million in expenses as a result of the events that occurred on April 16, 2007.

2. Workplace Violence Prevention is Everybody's Business
Employees can play a critical role in helping to prevent workplace violence by embracing their organizations focus on creating a violent free work environment. Organizations should invest resources and time on increasing employee awareness of importance of reporting threats and incidents. Reporting procedures and contact information should be absolutely clear and widely understood.

On the organizations side it is also critical that the ‘left hand talk to the right hand.' Too often there is important information about an employees' problematic behavior in one part of the organization that is not shared and other functions are not made aware of the situation.

3. Threat Assessment Begins Before An Individual Is Hired
Thorough background and reference checks are critical interventions that when done well can oftentimes detect problems that signal the potential for future problems. Also integrity, honesty and threat assessment tools are getting better and better and should be considered as part of an arsenal of pre-employment screening to help organizations avoid making bad hires.

In addition too many organizations fall prey to the belief that once a pre-employment assessment is satisfactorily passed that an employees' behavior will remain good over the life time of their employment. The fact that 64% of fraud incidents are perpetrated by employees and incidents of employees stealing identities, information and property are rampant debunk this belief. To combat fraud organizations need to conduct Infinity Screening (post hire employment checks) to start to identify problems and weed them out before serious damage is done.

Also according to a Society of Human Resource Management (SHRM) report - At Work in 2020'- It is estimated that 500 million people - or double the number today – will legally work outside their countries in the next 20 years. This means that more firms will need to implement more vigorous processes for investigating backgrounds of foreign nationals.

4. Early Identification of Threats is Important
Organizations need to significantly increase their knowledge and awareness of the full range of aberrant behaviors and events that may indicate an increased risk for the potential for an individual to commit violence. In line with this organizations need to implement an ‘individual threat assessment' process to ensure that proper evaluation occurs of problem individuals and appropriate guidance is provided regarding the right steps to take to mitigate risk.

A recent study reviewed 1,800 incidents of workplace violence over the past 26 years and concluded that there were warning signs in 71 percent of the time.

5. A Systematic Approach to Threat Intervention is Necessary
Organizations must establish an array of possible interventions to address identified ‘risk' ranging from a supervisor dialoguing with an employee to HR dialoguing with the employee to a referral to EAP to Fitness for Duty Assessment and Formal Threat Assessment.

6. Workplace Violence Shooter Incidents Require A Rapid Transition From Normal Operations To Ensure Effective Disaster Response. 

Organizations need to develop mass warning and notification capabilities with the ability to warn all personnel within 10 minutes of incident notification and immediately mobilize their crisis response efforts. This is a tall order that requires extensive advance preparation efforts that include first responders to ensure an integrated response. Ensure you have a clear emergency number for employees to call, regularly communicate this information and practice your crisis response. The Fort Hood response to their shooting incident illustrated how a well planned and rehearsed crisis response effort can reduce the carnage and save peoples' lives.

7. Active Shooter Preparation is Essential
Train all personnel in ‘Active Shooter' life preservation tactics and if feasible, include First Responders to enhance their understanding of your business environment and to have a coordinated response.

8. It's Not Whether Your Organization Will Experience A Domestic Violence Incident, It's When

Violence is a desperate attempt of a person to gain control over a situation they are confronted with and intimate relationships unfortunately have demonstrated their capability to bring out the worst in human behavior. Organizations need to face the reality that domestic violence happens far too often in the workplace and begin to address this as an organization problem.

Organizations such as the Corporate Alliance to End Partner Violence and Violence Prevention Fund have a wealth of information on how organizations can address domestic violence in the workplace.

9. Conflict Is Inevitable, but Violence Is Not
According to the Bureau of Labor Statistics the leading circumstance that leads to homicide is conflicts between people who know each other. This strongly suggests that conflict resolution skills are important and that organizations should make conflict resolution a core competency for supervisors and employees. Resolving conflicts and having skills in how to defuse a hostile situation at an early stage is a strong beginning to preventing issues from escalating to violence.

10. Learning the Hard Way
Studies reveal that organizations usually have a better response to a disaster the second time around. But the extent to which a company prepares for a reoccurrence depends on whether it asked the right questions and learned the right lessons the first time. We believe that waiting to learn from an initial event is pathetic and that firms can learn from other organizations events and through practice drills.

Over 300 psychiatrists, psychologists and mental health professionals worldwide have been convicted of sex crimes in the last 27 years. Hundreds of others have lost their licenses.

The Supreme Court of Penticton in British Columbia, Canada will fix the date for the sentencing hearing of psychiatrist Larry Anderson on September 26, 2005. Anderson was found guilty of three counts of indecent or sexual assault involving female patients over several years by a jury trial on July 23, 2005. (Court case # 31377)

According to evidence given during the trial, Dr. Anderson once put sexual instructions onto what a female patient thought was a prescription for anti-depressant drugs. This former female patient told AndersonÂ’s B. C. Supreme Court trial that instead of a renewal of a prescription for her continued depression, Anderson handed her something completely unexpected. (The prescription read: Take one erection and put it in an appropriate space. Do what is needed to obtain satisfaction.)

Brian Beaumont, spokesperson for the British Columbia chapter of the Citizens Commission on Human Rights said, “Psychiatric sexual assault is a very common occurrence over the world, but all too often the perpetrator is only slapped on the wrist by being given a fine or suspension from practice. Over 300 psychiatrists, psychologists and mental health professionals worldwide have been convicted of sex crimes in the last 27 years. Hundreds of others have lost their licenses.”

However, the complaint processes are thwarted, in part, by the belief that psychiatrists are above reproach. However, a woman is at greater risk of being raped while on a psychiatrist's couch than while jogging alone at night through a city park.

Studies show that between 6% and 13% of psychiatrists and psychologists sexually abuse their patients and, according to one American Journal of Psychiatry study, 80% of psychiatrists reporting sexual contact did so with an average of six patients.

Over 10 civil suits for sexual assault filed against psychiatrists have been settled out of court in favor of women in British Columbia, Canada, alone, in the past 15 years. Three of these civil suits were filed against one psychiatrist by three different women. This figure does not include the numerous complaints of sexual assault filed and dealt with by the College of Physicians and surgeons, the body that disciplines doctors.

Numerous studies report that psychiatrists, child psychiatrists and psychologists are significantly over-represented in sexual crimes. According to a 2001 study, "Sex Between Therapists and Clients," by Kenneth Pope, a former head of the ethics committee for the American Psychological Association, 1 out of 20 clients who had been sexually abused by their therapist was a minor, the average age being 7 for girls and 12 for boys. The youngest child was 3.

The Citizens Commission on Human Rights was established by the Church of Scientology to investigate and expose psychiatric violations of human rights.
